Terms of Service

1. Acceptance
These Terms of Service (“Terms”) govern your use of MySkii, a peer-to-peer skills marketplace operated by MySkii Ltd. (“MySkii”, “we”, “us”). By creating an account or otherwise using MySkii, you agree to these Terms. If you don't agree, don't use the service.
We may update these Terms. Material changes will be posted here with a new effective date; continued use after changes means you accept them.
2. About MySkii
MySkii is a marketplace where members trade skilled work using credits, an internal unit of account. MySkii is not a party to any task you post or deliver — we provide the platform, escrow, and dispute mechanics; the work agreement is strictly between the buyer and the seller.
3. Your Account
You must be at least 16 years old to use MySkii. You're responsible for the activity on your account, including keeping your email and authentication credentials secure. Notify us immediately if you suspect unauthorized access.
Each person gets one account. Creating multiple accounts to manipulate reviews, reputation, or escrow is prohibited and grounds for suspension.
4. Credits
Credits are an internal unit used to price and settle tasks on MySkii. Credits are not money, not a stored-value instrument, not redeemable for cash, and have no value outside the platform. Purchasing credits (when that feature is enabled) means acquiring a license to use them within MySkii, not a financial deposit.
Credits are non-refundable except where required by law or where MySkii determines a refund is warranted (e.g., service failure on our side, resolved dispute). Credits do not expire while your account is active.
When you claim a task, credits equal to the task price are placed in escrow from the buyer's balance. They release to the seller on successful confirmation or return to the buyer on successful dispute.
5. Posting Tasks & Content
Posted tasks must accurately describe the deliverable, price, and any relevant constraints. You must own or have the right to request the work described.
You may not post tasks that:
- violate applicable law, including copyright, trademark, or privacy;
- request deceptive or fraudulent work (fake reviews, spam, astroturfing);
- solicit sexual content, illegal goods/services, or anything intended to harass or harm;
- request circumvention of another platform's terms (bot development for banned use cases, account takeover, etc.);
- contain personal data of third parties without a lawful basis.
Content you post (descriptions, messages, uploads) remains yours. You grant MySkii a worldwide, non-exclusive license to store, display, and transmit that content as necessary to operate the service.
6. Claiming & Completing Tasks
When a seller claims a task, the buyer's credits move into escrow and the seller commits to deliver by the stated deadline (or within a reasonable time if no deadline was set).
When the seller marks a task delivered, the buyer has a review window to confirm, request a revision, or open a dispute. If the buyer takes no action within the auto-release window, credits release to the seller automatically.
Both parties may post reviews after completion. Reviews must describe the actual work; fake, incentivized, or retaliatory reviews are grounds for removal and account action.
7. Intellectual Property of Delivered Work
Until a task is confirmed, uploaded deliverable files carry watermarks and usage restrictions we apply for IP protection. On successful confirmation, the seller grants the buyer the rights described in the task posting (or, if unstated, a non-exclusive, worldwide license to use the delivered work for its stated purpose). Full copyright transfer requires explicit written agreement between buyer and seller.
Sellers warrant that delivered work is original or properly licensed and doesn't infringe third-party rights. If a legitimate infringement claim arises, we may remove content under our DMCA process and suspend involved accounts.
8. Disputes
If a buyer believes the delivery doesn't match the task description, they may open a dispute within the review window. MySkii (or a community arbitration panel, where available) reviews evidence from both sides and resolves by releasing credits to the seller, returning them to the buyer, splitting them, or requiring further work.
MySkii's dispute decisions are final at the platform level. Nothing in this section waives any statutory rights you may have under applicable consumer-protection law.
9. Prohibited Uses
You may not: (a) circumvent escrow by arranging payment outside the platform; (b) scrape, reverse-engineer, or overload the service; (c) use automated agents to spam task listings, messages, or reviews; (d) impersonate others; (e) engage in harassment, discrimination, or threats; (f) upload malware or exploit vulnerabilities in the platform or in other users.
10. Suspension & Termination
We may suspend or terminate accounts that violate these Terms or present risk to other users. You may close your account at any time via Settings → Delete Account. Deletion anonymizes your profile while preserving the audit trail of completed transactions (required for accounting and dispute history).
Credits in an account suspended for fraud or abuse may be forfeit; credits in an account closed in good standing remain usable until final settlement of any outstanding tasks or disputes.
11. Disclaimer & Limitation of Liability
MySkii is provided “as is” without warranty of any kind. We don't guarantee that any particular task will be matched, that deliverables will meet your expectations, or that the platform will be uninterrupted.
To the fullest extent permitted by law, MySkii's liability for any claim arising from your use of the service is limited to the credits you paid into MySkii in the 12 months preceding the claim, or USD 100, whichever is greater. This limitation does not apply to liability for gross negligence, willful misconduct, or where exclusion is not permitted by law.
12. Indemnification
You agree to indemnify MySkii against third-party claims arising from your content, your breach of these Terms, or your violation of law in connection with your use of the service.
13. Governing Law & Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-laws principles. Any dispute arising from these Terms or the service will be resolved first through good-faith negotiation; if unresolved after 30 days, exclusive jurisdiction lies with the courts of Ontario, unless you elect small-claims court where available.
You waive the right to bring claims on a class or representative basis to the extent permitted by law. Nothing here prevents you from reporting conduct to a regulator.
14. Changes to These Terms
We'll post changes here and bump the Version and Effective Date. For material changes, we'll also notify active users by email.
